Šios pirkimo – pardavimo sąlygos ir taisyklės (toliau – Taisyklės) yra privaloma ir neatsiejama dalis, kurioje nustatomos Jūsų (toliau – Pirkėjas) ir elektroninės parduotuvės thesmartcv.lt (toliau – Pardavėjas) teisės ir pareigos, paslaugų įsigijimo, apmokėjimo, pristatymo ir pinigų grąžinimo tvarka.
1. BENDROSIOS NUOSTATOS
Naudotis Pardavėjo el. parduotuvės paslaugomis turi teisę:
-Nepilnamečiai nuo šešiolikos iki aštuoniolikos metų amžiaus tik turėdami tėvų, įtėvių arba globėjų sutikimą, išskyrus tuos atvejus, kai savarankiškai disponuojama savo lėšomis;
-Visi juridiniai asmenys;
-Visų aukščiau nurodytų asmenų tinkamai įgalioti atstovai. Ne jaunesni kaip 18 metų amžiaus veiksnūs fiziniai asmenys;
-Paslaugų kainos, nurodytos Pardavėjo el. parduotuvėje, galioja tik perkant/užsakant šias paslaugas Pardavėjo el. parduotuvėje. Kainos pateikiamos eurais.
-Pirkėjas, norėdamas naudotis Pardavėjo el. parduotuvės paslaugomis, pirmiausia turi išsirinkti patikusią paslaugą iš siūlomų Pardavėjo el. parduotuvėje. Pirkėjas, išsirinkęs norimą paslaugą, spaudžia ant mygtuko UŽSAKYTI. Tada pirkinys atidurs pirkinių krepšelyje. Savo pirkinių krepšelį Pirkėjas gali pamatyti puslapio dešinėje pusėje viršuje, kur pasirenkama apmokėti paspaudžiant ant TĘSTI ATSISKAITYMĄ. Po to Pirkėjas nukreipiamas pildyti pirkėjo informacijos. Užpildžius reikiamus laukelius, spaudžiama APMOKĖTI. Apmokėjimui naudojame Paysera paslaugų tiekėją, kuris suteikia galimybę atsiskaityti el. bankininkyste. Po apmokėjimo, Pirkėjas gaus el. laišką su mokėjimo patvirtinimu ir tolimesniais žingsniais. Toliau Pardavėjo ir Pirkėjo bendradarbiavimas vyksta el.paštu.
-Sutartis tarp Pirkėjo ir Pardavėjo laikoma sudaryta nuo to momento, kai Pirkėjas el.parduotuvėje, suformavęs prekių krepšelį, atlieka visus paeiliui veiksmus užsakymui pateikti. Kiekviena sutartis sudaryta tarp Pirkėjo ir Pardavėjo yra saugoma Pardavėjo duomenų bazėje.
-Pardavėjas pasilieka teisę pakeisti, papildyti ar taisyti šias Taisykles.
2. ASMENS DUOMENŲ APSAUGA
-Pirkdamas thesmartcv.lt parduodamas paslaugas Pirkėjas privalo nurodyti savo asmens duomenis (vardą, pavardę, galiojantį elektroninio pašto adresą). Pirkėjo informacija yra naudojama tik įsipareigojimams tarp Pirkėjo ir Pardavėjo vykdyti ir interesams apginti.
-Pardavėjas įsipareigoja neatskleisti Pirkėjo asmens duomenų tretiesiems asmenims. Pirkėjo asmens duomenys tretiesiems asmenims gali būti atskleidžiami tik Lietuvos Respublikos teisės aktų numatyta tvarka.
-Smart CV nesaugo jokių Pirkėjo bankinių duomenų (tokių kaip slaptažodis, sąskaitos numeris ir pan.), kadangi mokėjimo metu Pirkėjas yra nukreipiamas į išorines sistemas.

3. PIRKIMO-PARDAVIMO SUTARTIES SUDARYMAS
-Laikoma, kad Pirkėjui patvirtinus suformuotą užsakymą, tarp Pirkėjo ir Pardavėjo sudaroma pirkimo-pardavimo sutartis.
-Ši pirkimo-pardavimo sutartis įsigalioja tik Pirkėjui apmokėjus užsakymą.
-Pirkėjui neapmokėjus užsakymo, laikoma, kad Pirkėjas vienašališkai nutraukė sutartį.
4. PIRKĖJO TEISĖS IR PAREIGOS
-Pirkėjas turi teisę pasirinkti ir užsisakyti bet kurią paslaugą, pateikiamą Pardavėjo el. parduotuvėje.
-Pirkėjas, naudodamasis Pardavėjo el. parduotuvės paslaugomis, sutinka su šiomis Pirkimo – pardavimo sąlygomis ir taisyklėmis ir įsipareigoja jų besąlygiškai laikytis.
-Pirkėjas, pateikdamas užsakymą paslaugoms ir/ar sudarydamas sutartį su Pardavėju, įsipareigoja pateikti išsamius ir teisingus duomenis.
-Pirkėjas atsako už visus teisėtus ir neteisėtus veiksmus, atliktus naudojantis Pardavėjo el. parduotuve.
-Pirkėjas atsakingas už šių Taisyklių laikymąsi, jei su jomis ir nesusipažino, nors tokia galimybė buvo suteikta.
5. PARDAVĖJO TEISĖS IR PAREIGOS
-Pardavėjas įsipareigoja suteikti Pardavėjui paslaugas per 2-3 darbo dienas arba 24 valandas, priklausomai nuo to, kurį variantą Pirkėjas pasirinko atsiskaitymo puslapyje.
-Jeigu užsakymo pateikimo ir/ar sutarties su Pardavėju sudarymo metu ar vėliau Pirkėjas pateikia melagingus, netikslius, klaidinančius ar ne visus reikalaujamus pateikti duomenis, arba nesilaiko kitų įsipareigojimų, numatytų šiose taisyklėse, Pardavėjas turi teisę nedelsiant panaikinti Pirkėjo užsakymą ir apriboti Pirkėjui teisę naudotis Pardavėjo el. parduotuvės teikiamomis paslaugomis.
-Pardavėjas turi teisę, be išankstinio perspėjimo, sustabdyti arba nutraukti Pirkėjo užsakymo vykdymą ir/ar naudojimąsi el. parduotuvės paslaugomis, jei yra pagrindo manyti, kad Pirkėjas užsiima neleistina veikla ar kitaip bando pakenkti Pardavėjo el. parduotuvės darbui arba stabiliam veikimui.
-Pardavėjas turi teisę teikti bei atšaukti teikiamas paslaugas. Pvz., jeigu yra pagrindo manyti, kad Klientas bando pakenkti, švaistyti laiką ir kalbėti apie tai, kas nesusiję su paslaugos teikimu, siųsdamas įvairaus pobūdžio žinutes ar el. laiškus, Pardavėjas turi teisę neatrašyti į žinutes arba jį užblokuoti ir atšaukti užsakytas paslaugas bei negrąžinti pinigų už atliktą darbą, jeigu iškyla tokia situacija ir atšaukti sutartį.
-Pardavėjas neatsako už jokius trečiųjų asmenų veiksmus, kai tokie asmenys, pasinaudoję Pirkėjo bankininkystės sistema, pateikia užsakymus ir/ar sudaro sutartis ir/ar atsiskaito Pardavėjo el. parduotuvėje.
-Pardavėjas turi teisę bet kuriuo metu, neįspėjęs Pirkėjo, laikinai sustabdyti elektroninės parduotuvės veiklą tam, kad atliktų atnaujinimus (tokius kaip programiniai patobulinimai ir pan.).
-Pardavėjas turi teisę vienašališkai, be išankstinio įspėjimo savo nuožiūra sustabdyti, pildyti, keisti šias taisykles ir kitus su taisyklėmis susijusius dokumentus, apie tai informuodamas Pirkėją el. parduotuvėje. Taisyklių papildymai ar pakeitimai įsigalioja nuo jų paskelbimo dienos, t. y. nuo tos dienos, kai jie yra patalpinami el. parduotuvės sistemoje.
6. PASLAUGŲ SUTEIKIMAS
-Pirkėjas, apmokėjęs už paslaugą (CV rašymas, motyvacinis laiškas, LinkedIn optimizavimas), gaus atliktus darbus per 2-3 darbo dienas nuo asmeninės informacijos gavimo iš Pirkėjo (atsakyto klausimyno, turimo CV atsiuntimo). Jei Pirkėjas užsisakė darbus su atlikimo terminu per 24 valandas, jis gaus darbus per 24 valandas.
-Pirkėjas, užsisakęs konsultacines paslaugas, gaus el. laišką su tolimesniais veiksmais (šiuo atveju, laiko pasirinkimas). Pasirinkus tinkamą laiką, klientas turės atsakyti į reikiamus klausimus ir klientui bus paskirta individuali konsultacija nuotoliniu būdu.
7. PINIGŲ GRĄŽINIMAS
-Pinigai gali būti grąžinti tik tuo atveju, jeigu už apmokėtas paslaugas, jos nebuvo įvykdytos. Taisymai ir koregavimai, susiję su paslaugos teikimu yra atliekami iki tol, kol Pirkėjas yra patenkintas galutiniu variantu.
-Negalėdamas įvykdyti užsakymo dėl susidariusių nenumatytų aplinkybių, Pardavėjas įsipareigoja grąžinti pinigus per 14 dienų į pradinę Pirkėjo sąskaitą. 8. BAIGIAMOSIOS NUOSTATOS -Jeigu Pirkėjas nesutinka su nauja taisyklių redakcija, daliniais papildymais, pakeitimais, Pirkėjas turi teisę jų atsisakyti, su sąlyga, kad praranda teisę naudotis eletroninės parduotuvės paslaugomis. -Jei po taisyklių pakeitimo Pirkėjas ir toliau naudojasi elektroninės parduotuvės teikiamomis paslaugomis, laikoma, kad jis sutinka su nauja taisyklių redakcija, daliniais pakeitimais ar papildymais. -Visi nesutarimai dėl šių taisyklių ir iš jų kylančių įsipareigojimų vykdymo sprendžiami derybų keliu, o nesusitarus derybose – įstatymų nustatyta tvarka. -Turėdami kokių nors klausimų, galite susiekti el.paštu thesmartcv@gmail.com
Terms and Conditionals
These Terms and Conditions of Sale and Purchase (hereinafter referred to as the „Terms and Conditions”) are a binding and integral part of the Terms and Conditions of Sale and Purchase, which set out the rights and obligations of you (hereinafter referred to as the „Buyer”) and the online shop thesmartcv.lt (hereinafter referred to as the „Seller”), as well as the procedures for the purchase of the services, the payment, the delivery and the refund.
- GENERAL PROVISIONS
The following are entitled to use the Seller’s e-shop services:
Minors between the ages of sixteen and eighteen only with the consent of their parents, adoptive parents or guardians, except in the case of self-disposal;
-All legal persons;
-Duly authorised representatives of all the above. Natural persons of legal age at least 18 years;
-The prices of the services indicated in the Seller’s e-shop are valid only when purchasing/ordering these services in the Seller’s e-shop. Prices are in Euros.
-To use the Seller’s e-shop services, the Buyer must first select the service he/she likes from the services offered in the Seller’s e-shop. Once the Buyer has selected the service he/she wants, he/she shall click on the ORDER button. The purchase will then open in the shopping cart. The Buyer can see his shopping cart at the top right side of the page, where he chooses to pay by clicking on CONTINUE PAYMENT. The shopper is then directed to complete the shopper information. Once the required fields have been filled in, click on PAY. For payment we use Paysera service provider, which provides the possibility to pay by e-banking. After payment, the Buyer will receive an email with confirmation of payment and next steps. Further cooperation between the Seller and the Buyer takes place via email.
The contract between the Buyer and the Seller shall be deemed to be concluded from the moment the Buyer completes all the successive steps to place an order in the e-shop by creating a shopping cart. Each contract concluded between the Buyer and the Seller is stored in the Seller’s database.
-The Seller reserves the right to modify, supplement or amend these Terms and Conditions.
- PROTECTION OF PERSONAL DATA
-When purchasing the services sold by thesmartcv.lt, the Buyer is obliged to provide his/her personal data (name, surname, valid e-mail address). The Buyer’s information is used only for the performance of the obligations between the Buyer and the Seller and for the protection of their interests.
-The Seller undertakes not to disclose the Buyer’s personal data to third parties. The Buyer’s personal data may only be disclosed to third parties in accordance with the procedure provided for by the legislation of the Republic of Lithuania.
-Smart CV does not store any of the Buyer’s banking data (such as password, account number, etc.), as the Buyer is redirected to external systems during the payment.

- CONCLUSION OF THE SALE AND PURCHASE AGREEMENT
-Once the Buyer has confirmed the order formed, a contract of sale shall be concluded between the Buyer and the Seller.
-This Purchase and Sale Agreement shall only become effective upon payment of the order by the Buyer.
-If the Buyer fails to pay the order, the Buyer shall be deemed to have unilaterally terminated the contract.
- RIGHTS AND OBLIGATIONS OF THE BUYER
-The Buyer shall have the right to select and order any of the services available on the Seller’s e-shop.
-By using the Seller’s e-shop, the Buyer accepts these Terms and Conditions of Sale and Purchase and undertakes to comply with them unconditionally.
-The Buyer undertakes to provide complete and correct data when placing an order for services and/or entering into a contract with the Seller.
-The Buyer shall be liable for all lawful and unlawful acts committed through the use of the Seller’s e-shop.
-The Buyer shall be responsible for complying with these Terms and Conditions, even if he/she has not made himself/herself aware of them, although he/she has been given the opportunity to do so.
- RIGHTS AND OBLIGATIONS OF THE SELLER
-The Seller undertakes to provide the Seller with the Services within 2-3 working days or 24 hours, depending on which option the Buyer has chosen on the checkout page.
-If the Buyer provides false, inaccurate, misleading or incomplete data, or fails to comply with other obligations under these Terms and Conditions at the time of placing an order and/or concluding a contract with the Seller, or thereafter, the Seller shall have the right to immediately cancel the Buyer’s order and to limit the Buyer’s right to use the Seller’s e-shop services.
The Seller shall have the right, without prior notice, to suspend or terminate the execution of the Buyer’s order and/or the use of the Seller’s e-shop services if there are grounds to believe that the Buyer is engaging in unauthorised activities or otherwise attempting to undermine the operation or stable functioning of the Seller’s e-shop.
-The Seller shall have the right to provide and cancel the services provided. For example, if there is reason to believe that the Customer is attempting to harm, waste time and talk about things that are not related to the provision of the service by sending various types of messages or emails, the Seller shall have the right not to reply to the messages or to block the Seller and to cancel the services ordered and to withhold the money for the work performed, if this situation arises, and to cancel the contract.
The Seller shall not be liable for any actions of third parties when such parties use the Buyer’s banking system to place orders and/or enter into contracts and/or make payments in the Seller’s e-shop.
The Seller shall have the right to temporarily suspend the operation of the e-shop at any time, without notice to the Buyer, in order to carry out updates (such as software upgrades, etc.).
-The Seller shall have the right to unilaterally, at its sole discretion and without prior notice, suspend, amend, modify these Rules and other documents related to the Rules, informing the Buyer thereof in the e-shop. Additions or amendments to the Rules shall take effect from the date of their publication, i.e. the date on which they are posted on the e-shop system.
- PROVISION OF SERVICES
-The Buyer, having paid for the service (CV writing, cover letter, LinkedIn optimisation), will receive the completed work within 2-3 working days of receiving the personal information from the Buyer (answered questionnaire, uploaded CV). If the Buyer has ordered the work with a deadline of 24 hours, the Buyer will receive the work within 24 hours.
-If the Buyer has ordered consultancy services, he will receive an email with the next steps (in this case, the choice of time). Once a suitable time has been selected, the client will be asked to answer the required questions and an individual remote consultation will be scheduled.
- REFUND OF MONEY
-Money can only be refunded if the services paid for have not been carried out. Corrections and adjustments relating to the provision of the service are made until the Customer is satisfied with the final version.
-If the Seller is unable to fulfil the order due to unforeseen circumstances, the Seller undertakes to reimburse the money within 14 days to the Buyer’s original account. 8. FINAL PROVISIONS -If the Buyer does not agree with the new wording of the Rules, amendments, modifications, the Buyer has the right to refuse them, provided that the Buyer loses the right to use the services of the e-shop. -If after the change of the Rules, the Buyer continues to use the services of the e-shop, he is deemed to agree with the new wording of the Rules or amendments or additions. -Any disagreements regarding the performance of these Terms and Conditions and the obligations arising therefrom shall be settled by negotiation and, in the absence of such negotiation, by the procedure provided for by law. -If you have any questions, you may contact thesmartcv@gmail.com
